Certain things amaze me. One is two border patrol agents are behind
bars for shooting a man who was, of all things, illegally in this
country. Wait, there’s more. He was driving a van with 743 lbs of pot
in it. The story is this:
“Agents Ignacio Ramos and Jose Compean
recently began serving their respective prison sentences of 11 and 12
years after being convicted of shooting Aldrete-Davila and trying to
cover it up.
The pair encountered Aldrete-Davila in February 2005 in
a van later found to contain 743 pounds of marijuana. When the Mexican
tried to flee, the agents shot him in the buttocks as he was crossing
back over the border.”
Now, if I am a border patrol agent who is
pursuing an obvious illegal alien who is running from me, I am going to
do everything in my power to stop him, especially if he is driving into
my country with 743 lbs of marijuana. Shooting to wound is not a shoot
to kill mentality.
Now the ‘victim’ in this case is thinking
of suing the federal government for negligence. His attorney feels that
$5 million is a good number to start with. This is outrageous! Yes, it
may be legal for a foreigner to sue our country, technically. But let’s
look at these facts. He was here illegally. He was driving a van filled
with drugs which are also illegal in this country and he ran from
officers. He broke the law 3 times. So why should it matter that he was
shot in the buttocks? At least he wasn’t killed. These 2 border patrol
agents did their job, in my opinion, and in the opinion of many other
law makers in this country. So our government sends these 2 brave
individuals to jail, while this illegal drug smuggler goes free and now
wishes to sue the same government, who sentenced our two agents to
prison, for $5 million. I suppose the wound he received was a $5
million wound.
When asked, by Fox News’ Neil Cavuto, if he
planned on pardoning these men, President Bush danced around the
question. He said there are several steps to go through. The case must
be examined.
Mr. President, what needs to be examined? By
sentencing these men, we are giving the drug smugglers notice that it’s
okay to come into our country, we won’t hurt you! The message may
filter to terrorists as well who, if caught by our agents and harassed
can always sue us for millions. This is not a tough stance on border
security. It’s a cop out. If the President and others believe that
building a silly wall is going to keep these people out he is sorely
mistaken. Aggressive border security requires our agents to have more
flexibility when dealing with people crossing the border illegally.
This ‘political correctness’ and these ‘procedures’ the agents follow
need to be examined.
A Texas attorney, Walter Boyaki, stated
"They [the agents] violated the law of their procedures," the lawyer
said. "You don't get to violate your procedures. Your boss gives you
certain procedure follow. Don't violate those procedures. That's
negligence."
What about the multiple laws his client broke prior
to this confrontation? These lawyers are obviously not interested in
protecting the rights of these 2 agents. Walter may be a good ambulance
chaser. He has sued the government 500 times. What does this tell you
about the integrity of this man? The Texas Bar Association should be
looking into this gentleman’s record.
Ultimately, if you want
strict security on your border, you must not be afraid to enforce it.
This is what these 2 agents did. I applaud them for their work and hope
that the President gives them the pardon they deserve. Getting rid of
these frivolous law suits that waste tax payer money is the next step.
We are sending the wrong message to our enemies.
